The lawsuit alleges that Burish violated the FLSA by paying its employees a “draw” against future commissions instead of paying them their earned hourly wages plus overtime compensation for hours worked over 40 in a workweek. The named plaintiffs seek to recover unpaid wages and overtime compensation, liquidated damages, interest, and attorneys’ fees and costs.
